Inspire Real Estate Solutions hopes that this page will help clarify your rights and obligations as a tenant vacating a premises as we acknowledge that moving from one home to another can be a very stressful time. The vacate process starts when an occupant issues a RTA Form 13 – Notice of Intention to Leave or when a landlord issues a RTA Form 12 – Notice to Leave. Should an occupant issue a Notice of Intention to Leave they must provide a minimum of two (2) weeks written notice. If a landlord has no intention of renewing the lease they must provide the tenant/s with a minimum of two (2) months written notice.
When adequate notice is received the occupant/s will be contacted and advised of their vacate date. The occupant is required to remove all their belongings/property from the property and must leave it in good working order. The vacate date is the latest date that a vacating occupant can return the keys to Inspire Real Estate Solutions and the tenant is responsible for the rent until this date whether they are residing in the residence or not.
Upon leaving the residence the outgoing occupants are required to complete an RTA Form 14a – Exit Condition Report. Inspire Real Estate Solutions strongly recommends that you make our check list for cleaning your guide when preparing for your vacate process. Inspire Real Estate Solutions will also issue the outgoing occupant a ‘Vacate Envelope’ in which they will find; Letter (explaining the process to vacate), Cleaning Check List, RTA Form 14a – Exit Condition Report, Copy of the RTA Form 1a – Entry Condition Report, and a RTA Form 4 – Refund of Rental Bond.
Once the agent and outgoing occupant agree on the Bond to be refunded they will together submit a signed RTA Form 4 – Refund of Rental Bond. The outgoing occupant will be issued the agreed amount as directed by the signed form. If there is a disagreement on the return of the Bond, the outgoing tenant may file a dispute to the Residential Tenancy Authority (RTA).
